Terms and Conditions

General

1. Definitions:

When the following words with capital letters are used, this is what they will mean:

Customer:  person or person(s) who are in receipt of the Services.

You/Your:  the Customer

Course(s):are the training course(s) provided by D Charles Mason Photography;

Equipment: means all and any cameras, camera equipment and apparatus, and any other materials brought to the Venue and/or the Course by you;

Owners: means the owners and/or management of the Venue;

Services: the training services to be provided to you through the means of the Course and/ or workshops and any additional activities which we deem appropriate from time to time incorporated into the Course;

Venue: means the venue the Course(s) are to be held at;

Website: Our website located at www.dcharlesmason.co.uk or any subsequent URL which may replace it.

Booking system: online system allowing Customers to place orders and view details of the course(s)

2. Sales

All transactions made on this site are on the understanding that you agree to our Terms & Conditions. Your statutory rights are not affected.

3. Prices & Payments

All prices quoted on this site are in UK pounds

Postage and packaging costs, will be calculated at the checkout based on standard carrier rates.

3.1 Customs


International Tax, Customs & Import Duties are not included in the price. You are solely responsible for payment of any such charges.

4. Limitation on Liability

We make no warranty as to the accuracy of the information We place on our Website. The extent of our liability for any breach of these Terms and Conditions shall be limited to the value of the goods ordered by You. Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury as a result of our negligence.

5. Events beyond our reasonable control

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control.

6. Applicable Law and Jurisdiction

The contract shall be deemed to be made in England. All Contracts made between us and the Customer shall be governed by the laws of England and any dispute arising therein shall be subject to the exclusive jurisdiction of the English courts.

Print Sales

7. Ordering

The order fulfilment process is automated and on receipt of your order it will be entered into a queue to be forwarded to our supplier for fulfilment.  

The order will be held for one day, before proceeding to fulfilment.  Within this one day window it is possible to cancel the order by sending an email to Cancellation@dcharlesmason.co.uk.  If you do not cancel within this time, the order will then automatically proceed and cannot be cancelled while in production.  For returns and cancellations, please refer to paragraph 10 below.

The total turnaround time is considered to be the queue holding time, plus production time, plus the delivery. Dependent on the current workload and the stock of materials, delivery times may vary. We will email acknowledgement of your order and when ready, an estimated despatch time. If you need your order urgently, or by a certain deadline, please email first and we will do our very best to help you.

For metal print orders please allow between twelve to seventeen working days from the placement of the order for the order to be dispatched. (Working days excludes Bank Holidays & weekends)

Metal print orders will be packaged in foam wrap with corner protectors, and boxed.

8. Print Care

All prints are prepared from high-resolution files on materials of the highest quality and have an archive life of over sixty five years in normal conditions.

However, prolonged, direct sunlight on any photographic image prematurely ages it. Therefore, we recommend you place your product away from direct sunlight. 

Specific instructions on the care for the print, (dependent on the materials used) will be as detailed in the product description.

Book Sales

9. Book Orders

All book orders are fulfilled from existing stock.  Every care has been taken to ensure the description of products are correct. We aim to keep the website as up to date as possible but a listing of a book is not a guarantee that the book is currently in stock.  Unavailability of books will be notified as per section 12 of these terms and conditions.

We will confirm acceptance of your order by email.  A further email will be sent to the address specified on the Customer order to confirm the product has been despatched (‘Despatch Confirmation’).

10. Receipt of damaged goods

Great care is taken to wrap and pack your image carefully to avoid any damage in transit. However, if this does happen, we would ask that you get in touch with Us as soon as possible.

Goods should be inspected immediately on receipt and You must notify Us within seven working days by email at Returns@dcharlesmason.co.uk if the goods are damaged.   We will advise you of the address to return the damaged goods to and subject to inspection, we will provide a a replacement print at no charge, or provide a full refund.

11. Cancellation of order.

If You are a consumer based in the UK or the European Union You have the legal right to cancel your Order within seven (7) working days following your receipt of the Goods under the Consumer Protection (Distance Selling) Regulations 2000. Refunds will be processed under the Regulations in accordance with your legal rights.  

Unwanted goods must be posted back to us to arrive within fourteen days of delivery for a full refund. The costs of returning goods to us shall be borne by You, (unless the product is damaged on receipt, in which case paragraph ten applies.)

Upon receipt of the goods we will give You a full refund of the amount paid when the item was purchased.

11.1 Exceptions

The rights to return the goods to Us as referred to will not apply in the following circumstances: -

  • The Goods have been made to measure and/or personalised.
  • The goods do not have all original packaging and/or are not in a saleable condition.
  • The returned items are not received by Us within fourteen days of delivery.

12.  Unavailabilty of a product

If for any reason a product as described cannot be supplied, or is not available, we will inform You as soon as possible and issue a full refund where applicable. Where known, if the product is unavailable in the quantities requested, this will be shown at the shopping basket stage.  Dependent on the availability of stock, the order quantities will be automatically amended to the available stock level at the time of order prior to payment being requested.  You will have the option to continue or abandon the order.

Photography Classes

13. Placing an order for a course

13.1. Customer(s) can only attend a Course if they are over 16 years of age on the date of attendance at the relevant Course.  If a Customer is under 16 at the time of the Course, they will not be permitted to participate in the Course.

13.2. All orders to reserve a place on a course should be made online at www.dcharlesmason.co.uk, either by using the Website enquiry form, or an online Booking System which may be administered by a third party.  The Website will state the booking process for the Course.

13.3  Courses have a limited number of places.  Orders will be dealt with on a first come first serve basis.

13.4 Your data will be processed in accordance with the Data Protection Act legislation and will be used only for the purposes of the provision of the Services.

13.5  Courses may be presented in person, remotely using videoconferencing software, or a combination of both, for the duration of the course.  This will be shown at the time of booking.  It is the Customers responsibility to ensure that they book the course type appropriate to their requirement.

13.6  We will make all reasonable endeavours to ensure that the provision of content for online courses provided in real-time will be of serviceable quality.  The Customer acknowledges that the Internet is a “best efforts” variable service and We cannot guarantee the quality of the received service.  The Customer should satisfy themselves that their access to the Internet and computing equipment is sufficient to support online interactive services.

14.  Courses

At the time of booking, the Customer will be advised of the payment arrangements.

14.1  Pay on the day.  Card payments are preferred.  Customers will receive an electronic receipt via email.

14.2  Pay online.  Payments will be processed via a third party secure payment gateway.  Acknowledgement of payment will be via email.

15. Cancelling a Course booking

15.1 A Customer may cancel an order at any time.  We reserve the right to charge a cancellation fee (as detailed in the refund policy), which will be indicated at the time of placing the booking.

15.2 We reserve the right to amend the terms of the refund policy with immediate effect for new orders.  Any changes will be indicated at the time of booking prior to the Customer placing an order.

15.3 For orders placed, and payment made online, any monies due to the Customer, in line with the refund policy in effect at the time of placing the booking, will be refunded to the banking details used for the payment.

16. Customer Obligations when attending a course

You will:

16.1 comply with all reasonable instructions and directions issued by Us or any applicable Venue where the Course will take place (including, without limitation, in relation to health and safety or security requirements);

16.2 at all times throughout the Course and whilst in attendance at the Venue conduct yourself in an orderly manner and not act in any manner which causes offence, annoyance or inconvenience to other Course attendees, the Venue, or Us;

16.3 not cause or permit any damage to the Venue or any part of it or to any fixtures or fittings;

16.4 be responsible for the payment of any and all expenses incurred by you in relation to the Course;

16.5 inform Us either during the Course or within twenty eight (28) days after the final day of the Course of any complaint or problem with the Services, the Course or Us which you may have.

16.6  You agree and acknowledge that you have full responsibility for your mobility whilst on the Course and attending the Venue (both travel arrangements to and from the Course and your general mobility once at the Course Venue and whilst participating in the Course).

17. Changes to the Course

17.1 Prior to the Course date We reserve the right, for any reason (whether or not due to Events Outside Our Control), to change the, format, content, Venue and timing of the Course as advertised on the Website; We will use reasonable endeavours to notify you of any such change(s).

17.2 We reserve the right at any time after We have accepted your Order and for any reason (whether or not due to Events Outside Our Control) to cancel or change the format, content, Venue and timing of the Course.

17.3 In the event that We cancel or amend the Course under clause 17.2 you will be entitled to a full refund of any fees paid to Us.

18. Providing Services

18.1 We will supply the Services to you for the duration of the Course stipulated in your Order.

18.2  As a consumer, you have legal rights in relation to Services not carried out with reasonable skill and care, or if the materials We use are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these Terms will affect these legal rights.

19. Price and payment

Prices and payment terms are those that are detailed for the Course on the Website.

20.  Additional limitations on Our liability to you:

20.1 We do not make any warranty as to the Course in general and in particular in relation to: the benefit or outcome (commercial or otherwise) that You may achieve as a result of attending the Course.

20.2 We will have no responsibility or liability for any loss, theft, or damage to your property or effects, including but not limited to the Equipment.

20.3 In the event that the date of the Course is changed or the Course is cancelled by Us due to an Event Outside Our Control you will be informed as soon as possible (and We will use all reasonable endeavours to give you at least 24 hours' notice) prior to the scheduled commencement date for the Course and you will be entitled to either:

20.4  a full refund of any fees paid to Us,  or

20.5 attend the Course on the alternative date suggested by Us except in extreme cases where it is no longer possible to provide the Course.

21. Intellectual Property Rights

Any and all intellectual property rights in the Course materials are owned by Us and will continue to be owned by Us.
